South Korea has issued a partially revised draft of the Implementation Order for the Labeling and Advertising of Food and Other Related Laws, proposing to increase the fine collection standards for false labeling of nutritional ingredients

On March 21st, the South Korean Ministry of Food and Drug Safety issued Announcement No. 2024-138, proposing to amend the Implementation Order of the Law on the Labeling and Advertising of Food and Other Products

Delegate matters related to the prohibition of drug labeling and similar labeling changes on food to the local Food and Drug Safety Department, focusing on the actual nutritional content

If the measured value exceeds 100% of the indicated nutritional content or does not meet the standard, the fine collection standard will be raised to strengthen consumers' right to know. The deadline for soliciting the above opinions is April 30, 2024. After the implementation of this regulation, imported products will be strictly inspected in accordance with relevant inspection and quarantine procedures and policies. Therefore, in order to avoid export discoveries, relevant enterprises are required to strictly follow the laws and regulations of the importing country for production, processing, packaging, and distribution. Samples will be confirmed with importers in strict accordance with local requirements, and production will be carried out strictly according to the confirmed samples to avoid the risk of goods being returned
